Legal Case of Ex-Rockwood Science Head Moved to Eureka

Rockwood School District managers and Eureka prosecuting attorney confirm the legal case filed against former employee, Michael Szydlowski, is still under way, but the venue has changed.

Patch reported Monday the had filed a complaint last year with the against the former head of the district's science department, Michael Szydlowski, regarding alleged stealing of district property and misuse of district funds. The complaint charges then were turned over from police to Eureka's prosecuting attorney firm, .

After several court continuances, a jury trial slated for this case did not occur as planned, on the docket, of the St. Louis County Circuit Court in Clayton Monday morning.

However, Monday afternoon, Kelvin McMillan, Rockwood's assistant superintendent of human resources, indicated the case "has not been settled."

Gina Tarte, Rockwood marketing/media specialist, said the case was moved from the St. Louis County Court to the for prosecution.

Prosecuting Attorney Kathy Butler told Patch on Monday afternoon that the defendant, Szydlowski, had withdrawn his request for a jury trial.

Butler said there was "no disposition of charges and no resolution of the case."

She said the only thing that was not moving forward was the deposition of McMillan by Szydlowski's defense attorney. She said the attorney no longer needed to depose McMillan because the matter was "not going to be put in front of a jury and the attorney already had McMillan's statement, so he knew what he was going to say to the judge."

Butler said the case now was remanded back to Eureka.
